Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of the LCH Painting & Flooring website and the services provided by LCH Painting & Flooring (“LCH,” “we,” “us,” or “our”).
By using our website, requesting an estimate, scheduling a project, or hiring LCH, you agree to these Terms.
1. Our Services
LCH provides residential flooring and related home improvement services.
Our services may include:
- Hardwood flooring installation
- Hardwood flooring refinishing
- LVP installation
- Epoxy flooring
- Flooring removal and demolition
- Flooring repairs
- Baseboard and trim work related to flooring projects
- Stair and railing work
- Other flooring-related services agreed upon in writing
The specific services provided will depend on the scope of work agreed upon between LCH and the customer.
2. Estimates and Pricing
Estimates provided by LCH are based on the information available to us at the time of the estimate.
Final pricing may change if:
- The actual condition of the flooring differs from what was represented
- Hidden damage or unsuitable subfloor conditions are discovered
- Additional preparation or repair work is required
- Additional materials or labor are required
- The customer requests additional work
- The project scope changes
- Existing conditions materially differ from those observed during the estimate
Unless otherwise stated in writing, an estimate is not a guaranteed final price until the scope and pricing have been confirmed by LCH.
3. Customer Responsibilities
The customer is responsible for:
- Providing accurate information about the project
- Providing reasonable access to the property
- Removing personal valuables and fragile items from work areas
- Informing LCH of known hazards or unusual property conditions
- Ensuring that the property is reasonably accessible and ready for the scheduled work
- Obtaining any required permission or authorization for work to be performed
Customers are responsible for notifying LCH of any items or areas that should not be disturbed.
4. Existing Conditions
Flooring projects can reveal conditions that are not visible before flooring is removed.
These may include:
- Damaged or deteriorated subflooring
- Moisture issues
- Uneven surfaces
- Structural deficiencies
- Previous improper installations
- Hidden damage
- Mold, rot, or pest-related damage
- Adhesive or flooring materials requiring additional preparation
LCH will communicate material conditions discovered during the project and may recommend additional work or adjustments to the project scope.
Additional work may result in additional charges.
5. Flooring Installation
Flooring materials can naturally vary in color, grain, texture, sheen, size, and appearance.
Natural hardwood in particular may contain variations, knots, mineral streaks, color differences, and other characteristics that are considered normal.
LCH cannot guarantee that installed flooring will exactly match photographs, samples, existing flooring, or previously installed flooring.
6. Hardwood Refinishing
Hardwood refinishing involves sanding, preparation, staining when applicable, sealing, and application of finish coats.
The final appearance of refinished flooring can be affected by the existing wood, previous finishes, stains, repairs, wood species, age, sunlight exposure, moisture, and other existing conditions.
LCH does not guarantee that all stains, discoloration, scratches, dents, pet damage, water damage, or other imperfections will be completely removed.
Where a customer selects a stain or finish color, the final appearance may vary depending on the existing wood and project conditions.
7. Epoxy Flooring
Epoxy and similar floor coatings require appropriate surface preparation and suitable environmental conditions.
The final appearance, adhesion, durability, and performance of an epoxy coating may be affected by moisture, substrate condition, temperature, humidity, previous coatings, contamination, and other conditions outside LCH's control.
LCH may decline to install an epoxy system when existing conditions are unsuitable or present an unreasonable risk of coating failure.
8. Furniture and Personal Property
Unless specifically included in the written scope of work, customers are responsible for moving furniture and personal belongings out of the work area.
If LCH agrees to move furniture, the customer understands that moving furniture carries an inherent risk of damage to furniture and property.
Customers should remove valuables, fragile items, electronics, artwork, and other sensitive belongings before work begins.
Unless otherwise agreed in writing, furniture placed back onto newly finished flooring may need to remain undisturbed for the curing period specified by LCH.
9. Dust and Construction Conditions
Flooring work, particularly hardwood removal, sanding, and refinishing, can create dust, noise, odors, and other normal construction conditions.
LCH will take reasonable measures to control dust and protect surrounding areas, but cannot guarantee that a project will be completely dust-free.
Customers should make appropriate arrangements for pets, children, occupants, and sensitive belongings during construction.
10. Materials
Materials included in a project will be identified in the customer's estimate or written agreement.
Material availability, manufacturer specifications, product discontinuations, and supply-chain conditions may affect product selection or scheduling.
When a specific product is selected by the customer, LCH is not responsible for manufacturer defects or changes to the manufacturer's product specifications.
11. Project Scheduling and Delays
LCH will make reasonable efforts to complete projects according to the anticipated schedule.
Project schedules may be affected by material availability, weather, humidity, site conditions, additional preparation or repair work, customer delays, manufacturer issues, or circumstances beyond LCH's reasonable control.
A projected completion date is not a guarantee unless specifically agreed to in writing.
12. Cancellations and Rescheduling
Customers should provide as much notice as reasonably possible if they need to cancel or reschedule a project.
Any deposit, cancellation, or rescheduling terms provided in the customer's written estimate or service agreement will apply.
Where applicable, deposits may be nonrefundable as specified in the written agreement.
13. Payment
Payment is due according to the terms provided in the customer's estimate, invoice, or written service agreement.
LCH may require a deposit before work begins, with remaining balances due according to the payment schedule provided in the agreement.
LCH reserves the right to pause or refuse additional work for accounts with unpaid balances.
14. Nonpayment
If an amount owed to LCH remains unpaid, we may take reasonable steps to collect the outstanding balance, including sending payment demands, using third-party collection services, or pursuing available legal remedies.
The customer may be responsible for reasonable collection costs, attorney fees, court costs, or other costs to the extent permitted by applicable law and the applicable written agreement.
15. Photos and Project Documentation
LCH may photograph or document work performed for estimating, scheduling, quality control, warranty, insurance, customer service, or business-record purposes.
Customers may provide photographs or videos of their property to assist with estimates.
LCH may use photographs of completed projects for marketing or promotional purposes unless the customer requests otherwise.
16. Website Use
You may use our website for lawful purposes only.
You agree not to:
- Interfere with the operation or security of the website
- Attempt to gain unauthorized access to systems or information
- Submit false or misleading information
- Use the website for fraudulent or unlawful purposes
- Copy or reproduce website content without permission
We may modify, suspend, or discontinue any portion of the website at any time.
17. Third-Party Services
LCH may use third-party companies and platforms for payment processing, scheduling, communications, advertising, analytics, material supply, and other business functions.
LCH is not responsible for the independent actions, policies, or services of third parties.
18. Limitation of Liability
To the fullest extent permitted by applicable law, LCH will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless LCH Painting & Flooring and its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, and expenses arising from:
- Your violation of these Terms
- Your lack of authorization to request services
- Misrepresentation of the property or project
- Failure to disclose known hazards or relevant conditions
- Your unlawful use of our services or website
20. Force Majeure
LCH will not be responsible for delays or inability to perform services caused by circumstances beyond our reasonable control, including severe weather, accidents, equipment failure, material shortages, manufacturer delays, labor disruptions, government actions, or other unforeseen circumstances.
21. Changes to These Terms
LCH may update these Terms from time to time.
Updated Terms will be posted on this page with a revised Effective Date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms to the extent permitted by law.
22. Governing Law
These Terms will be governed by the laws applicable to the services and transaction, without regard to conflict-of-law principles, except where applicable law requires otherwise.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
24. Entire Agreement
These Terms, together with any written estimate, proposal, invoice, or service agreement provided by LCH, constitute the agreement governing the applicable project.
If there is a conflict between these Terms and a specific written service agreement, the specific written agreement will control to the extent of the conflict.
